LOTTO & LOTTO Plus - Game Rules - This rules set is determined and enforced by Gidani as the sole oprator of the South African National Lottery. As a LottoButler customer, you agree to adhere to these game rules.
Gidani is licensed under The Lotteries Act, 1997 (Act No 57 of 1997) as amended to conduct and promote the National Lottery and Constituent Games in South Africa. These Rules apply to the game of LOTTO and LOTTO Plus which form part of the National Lottery.
The following words and terms, when used within these Rules, shall have the following meanings, unless the context clearly indicates otherwise:
Act Lotteries Act 57 of 1997 as amended. Board or Game Board A grid of numbers between 1 and 49 and the identifying and associated letter, which together constitute a single Game Board on a LOTTO Entry Coupon. Bonus Number The number randomly selected from the remaining forty three (43) numbers at a Draw immediately after the Main Numbers have been selected. Cancelled Draw Any Draw, which does not take place on the scheduled day. Claim Form The printed form issued by Gidani, which a Player must complete and submit to Gidani, together with a Valid Winning Ticket, in order to be eligible to claim certain prizes as specified in these Rules. Claimant A person who submits a claim for a LOTTO or LOTTO Plus prize within the applicable claim period as stipulated by these Rules. Defective Ticket A Ticket, which at the time of purchase is damaged, defaced, illegible or incomplete or which contains the words “void”, “sample” or “not for sale” or similar wording. Draw A process, which is used to randomly select a set of Winning Numbers. Draw Machine A device used by Gidani and authorised by National Lotteries Board for the random selection of Winning Numbers. Game Any Lottery Game operated or promoted by Gidani as part of the National Lottery. High – Tier Prize A prize of over R50 000. LOTTO Entry Coupons A preformatted card provided by Gidani bearing the numbers from which a Player can make his/her selection. A LOTTO Entry Coupon may carry several Game Boards and may be used to wager selections for both LOTTO and LOTTO Plus.
The Licence to Operate the South African National Lottery refers to an Entry Coupon as a Playslip. LOTTO An On-line Game utilizing a computerised terminal to record selections and also to validate prize claims.
LOTTO Plus LOTTO Plus is an extension of the LOTTO On-Line Game in which selections made for a LOTTO Draw are wagered for an additional corresponding LOTTO Plus Draw.
Low–Tier Prize: A prize between R1 and R5 000 inclusive.Mail Subscription A procedure adopted by Gidani, which enables a member of the Playing Public to participate in either in a LOTTO or LOTTO and LOTTO Plus Games for a multiple number of Draws other than by purchasing a Ticket at a Retail Outlet. Main Numbers The six numbers randomly selected at a Draw from the range 1 to 49 inclusive.
Mid-Tier Prize: A prize between R5 001 and R50 000 inclusive.
Minor: An individual younger than 18 years of age.
Multi-Draw: Several successive Draws in which a Player participates by selecting and specifying the number of Draws between 2 and 10 on a LOTTO Entry Coupon.
Player: A member of the public aged 18 years or over who purchases a National Lottery Ticket.
Players’ ‘HelpLine’: The National Lottery Call Centre that offers Customer Service to Players. This service is available toll free on 0800 777 777.
Playing Public: Members of the public who are eligible to purchase Tickets.
QuickPick: A method of selection that Players can choose instead of marking numbers themselves. The Terminal generates random sets of six numbers, which are printed on the LOTTO Ticket at the Players request.
Recipient: The person to whom a Mail Subscriber has assigned the rights in a subscription.
Regional Office: A National Lottery Office designated as such by Gidani.
Retailer: Any person, firm or company authorised by Gidani to sell Tickets and/or pay prizes in respect of Valid Winning Tickets.
Retailers’ ‘HelpLine’: The National Lottery Call Centre that offers Customer Service to Retailers. This service is available on 0800 GIDANI.
Retail Outlet: Any authorised premises (including premises where an attended vending machine is situated) where tickets in a Constituent Lottery are sold to Players.
Selection: One set of six numbers chosen by a Player within one Board on a LOTTO Entry Coupon and recorded on a Ticket (or in the case of subscriptions) Subscription Certificate, issued in accordance with these Rules.
Serial Number: The unique number assigned by Gidani’s central computer and printed on a Ticket which, subject to these Rules, provides for the verification of the Ticket as a valid winning Ticket or otherwise. The Serial Number may be in the form of digits, a bar code or any other form.
Subscriber: A person who completes a Mail Subscription Application Form, which is accepted by Gidani.
Terminal: The device, which allows Tickets to be printed and winning Tickets to be validated.
Ticket: A Ticket issued by a Terminal and sold by an authorised Retailer in an authorised manner.
Valid Winning Ticket: A winning Ticket, which meets all of Gidani’s Ticket validation requirements as set out or referred to in these Rules.
Winning Numbers: The Main Numbers and one Bonus Number, used to determine the winning entries.
3. ON-LINE GAME DRAWS
3.1 The LOTTO and LOTTO Plus Draws will take place on the night of the Draw day (i.e. Wednesday; Saturday) or such other days as may be specified by Gidani with the approval of the National Lotteries Board. The two Draws shall take place consecutively.
3.2 In each Draw seven (7) balls will be drawn at random from a Drawing Machine containing forty nine (49) balls numbered 1 to 49.
3.3 The first six (6) numbers drawn are the Main Numbers and the seventh number drawn is the Bonus Number.
3.4 Numbers are deemed to be drawn when a ball rests in the display section at the front of the Drawing Machine.
3.5 All Draws will be conducted in the presence of an independent auditor.
3.6 The Winning Numbers of a Draw shall be those drawn and as recorded in writing immediately following the Draw by an independent auditor as described in Rule 3.5 above.
3.7 In the event that any Draw is declared invalid in accordance with the procedures applicable to it, or is interrupted due to equipment failure, another Draw will be conducted to determine the Winning Numbers. In the case of equipment failure any numbers previously drawn will remain valid, and only the selection of the remaining balls will take place.
3.8 In the event that the Draw cannot take place on the advertised date or at the time fixed, it shall take place as soon as practicable thereafter.
3.9 All Draws will, as far as practicable, be conducted and broadcast live on television and will be recorded on a videotape which will be retained by Gidani. Failure by Gidani to record the Draw or retain the tape, or the partial or total failure of technical, electronic, or mechanical equipment used to record or broadcast
the Draw, will not invalidate the Draw.
3.10 Gidani shall have no obligation to make any payment against an incorrectly announced number at a Draw. In such an event, the witness as described in 3.5 shall confirm the correct numbers as recorded in Rule 3.6.
4. PLAYING LOTTO
4.1 Each LOTTO Game Board costs R3.50 inclusive of VAT at 14%.
4.2 The cost of a Multi-Draw Ticket will be the total cost of the Game Boards selected multiplied by the number of Draws the Player has chosen to enter.
4.3 Gidani will provide LOTTO Entry Coupons in all Retail Outlets at no cost to Players.
4.4 LOTTO Entry Coupons are provided solely for the convenience of Players and shall have no monetary or prize value, nor will they constitute evidence of a play or of the numbers selected. Except in the case of an entry by subscription, a Valid Winning Ticket shall be the only valid basis for claiming a prize.
4.5 On any one LOTTO Entry Coupon a Player may play a minimum of one Game Board.
4.6 Boards may be selected in any order.
4.7 A Player must manually mark in black or blue pen or pencil six (6) numbers from the numbers 1 to 49 inclusive on each of one or more Game Boards.
4.8 Where the Player uses the Multi-Draw facility he/she will mark his/her Selection(s) on the appropriate Boards on the LOTTO Entry Coupon and mark the appropriate box on the LOTTO Entry Coupon to determine the number of LOTTO
Draws for which his/her Selection (s) are to be entered.
4.9 For the purposes of selecting the “Number of Draws” for the Multi- Draw, a Player must mark the “Number of Draws” boxes on the LOTTO Entry Coupon. The period covered by the selected Multi - Draw shall commence on the first Saturday or Wednesday subsequent to the date on which a Player made his/her selection. This period shall end when the number of Draws selected and indicated on a Ticket are conducted.
4.10 The completed LOTTO Entry Coupon with the appropriate amount due shall then be submitted to the Retailer who will process the completed LOTTO Entry Coupon through the Terminal. A Ticket recording each selection marked on the coupon will be issued to the Player.
4.11 The Retailer shall process LOTTO Entry Coupons through the Terminal, and Tickets will be issued only through the Terminal.
4.12 If the Terminal rejects the LOTTO Entry Coupon, the entry is not valid.
4.13 A Ticket that contains numbers randomly generated by the Terminal may also be purchased. This is called a QuickPick Ticket. The Player must request such a Ticket from the Retailer. QuickPick Tickets are available for R5, R10, R20 or R50 to provide the Player with 2, 4, 8 or 20 board/game selections respectively.
4.14 QuickPick Tickets are also available for Multiple Draws. The Player must request the number of Draws ranging from 2 to 10 only.
5. PLAYING LOTTO PLUS
5.1 LOTTO Plus offers Players an option to enter their LOTTO Game Board selections for a corresponding LOTTO Plus Draw at an additional cost.
5.2 LOTTO Plus can only be played when playing LOTTO and the Game Boards entered for LOTTO Plus must be the same as the LOTTO Boards played.
5.3 Each LOTTO Plus entry costs R1.50 (one Rand), inclusive of VAT.
5.4 Players may play the LOTTO Plus Game by marking the LOTTO Plus box at the top of a LOTTO Entry Coupon. Provided that on the Entry Coupon the Player also enters at least one selection (one board) into the corresponding LOTTO Draw in terms of Paragraph 4.4. above.
5.5 LOTTO Plus is available using both the Entry Coupon and QuickPick methods of number selection.
5.6 If a Player wants to play LOTTO Plus through the Quick Pick method of selection, he/she must indicate the inclusion of the LOTTO Plus option when buying a QuickPick Ticket from a Retailer.
5.7 LOTTO Plus selections can also be entered for Multiple Draws, provided that the same Game Board selections are entered for corresponding LOTTO Multi- Draws in terms of paragraph 4.8. above.
5.8 The cost of entering Board Selections for the LOTTO Plus Draws will be the total cost of the Game Boards selected, multiplied by the number of Draws the Player has chosen to enter. This cost is additional to the cost of LOTTO entries.
5.9 If the Terminal rejects the LOTTO Entry Coupon, the LOTTO Plus entry is not valid.
6. TICKET SALES
6.1 Tickets can be purchased at any outlet that has an active terminal between:
6.1.1 06:00 – 23:00 on non-draw days i.e., Mondays, Tuesdays, Thursdays and Fridays
6.1.2 06:00 –21:00 on draw days i.e., Wednesdays and Saturdays
6.1.3 06:00 – 18:00 on Sundays
6.2 The LOTTO and LOTTO Plus Game sales are closed approximately 30 minutes before the Draw on Wednesday and Saturday evenings. Ticket sales and prize payments will not commence after the Draw until the next morning.
7. CANCELLATION OF A TICKET
7.1 A Ticket to which the provisions of 6.1 apply, may be cancelled provided that –
7.1.1 The Ticket is presented to the issuing terminal not earlier than three minutes after the time it was purchased.
7.1.2 The Ticket is presented to the issuing terminal within 2 hours of the time when it was purchased or prior to the close of the retail outlet where the issuing terminal is situated or the close of Ticket sales for that day or the Draw, whichever is the earlier, and
7.1.3 If the Ticket can be cancelled through the bar code reading device on the Terminal. The Retailer will be required to contact Retailers’ ‘HelpLine’ to receive authorization for cancellation in the event that the ticket to be cancelled is not readable by the bar code reading device.
7.1.4 On cancellation of a Ticket, the Player will be entitled to a refund from the Retailer equal to the retail price of the Ticket.
7.1.5 The Retailer will retain the cancelled Ticket together with the cancellation authorization issued by the terminal.
7.2 Cancellation of a Ticket affects entries to both LOTTO and LOTTO Plus Draws.
8. MULTI – DRAWS
8.1 A Multi-Draw Ticket shall not be capable of cancellation other than in accordance with Rule 7 above and, in any event, prior to the first Draw in respect of which the Ticket has been issued.
9. TICKET VALIDATION REQUIREMENTS
9.1 Before a prize may be paid on any Ticket, it must be validated according to Gidani’s validation procedures. Gidani’s decision as to whether or not the Ticket is valid shall be final and binding. Without prejudice to the generality of the foregoing, Gidani shall be entitled to declare a Ticket invalid, and accordingly shall not be obliged to pay any prize, if:
9.1.1 The Ticket has been cancelled, whether in accordance with Gidani’s normal procedure for cancellation or otherwise.
9.1.2 The Ticket is counterfeit, has been forged in whole or in part or fails to pass Gidani’s security tests.
9.1.3 The Ticket is mutilated, altered, unreadable, incomplete or tampered with in any manner.
9.1.4 The Ticket is not received by Gidani or the Retailer by the deadline or within the timescale applicable to the particular Game.
9.1.5 The Serial Number of an apparent winning Ticket does not appear on Gidani’s list of Serial Numbers of Winning Tickets or a Valid Winning Ticket with that Serial Number has been paid previously.
9.1.6 The Ticket does not appear on Gidani’s list of Tickets sold for entry to the particular Draw, kept on Gidani’s central computer, or the Ticket data fails to match the computer record of that Ticket in every respect.
9.1.7 Any number on the Ticket is not present in its entirety or is not fully legible.
9.1.8 The Ticket has not been issued or sold in an authorised manner by Gidani or by an authorised National Lottery Retailer.
9.2 Except in the case of Mail Subscriptions, a Ticket shall be the only valid proof that an entry was made in a Draw and a Valid Winning Ticket shall be the only valid instrument for claiming a prize.
9.3 Claimant shall be entitled to claim only the highest prize division qualified for by a winning selection and not for any lesser prize category or any otherwise unclaimed prize in the particular Draw or prize pool.
9.4 Gidani reserves the right to withhold payment of any prize until it is entirely satisfied as to the validity of any Ticket and that the Claimant is a bona fide winner, and reserves the right to call for proof of identity and capacity to claim.
9.5 Gidani reserves the right to photograph any Claimant for security purposes.
10. DISPUTED TICKETS
If a dispute arises between Gidani and the owner of a Ticket or Claimant as to whether a Ticket is a Valid Winning Ticket, and the Ticket prize claimed has not been paid, Gidani may, solely at its discretion, reimburse the cost of the Ticket or replace the disputed Ticket with a Ticket of equivalent sale price for any current LOTTO and LOTTO Plus Game. This shall be the owner of the Ticket or Claimant’s sole and exclusive remedy, and such reimbursement or replacement shall fully discharge Gidani from any liability in respect of such dispute.
11. GAME TERMINATION AND PRIZE CLAIM PERIOD
Prizes must be claimed no later than 23h00 on the 365th day after the Winning Draw date of the particular Game. Any such prize not claimed within this period will be forfeited. If a prize is claimed by post, Gidani must receive the Ticket, name, ID number and contact details on the back of the Ticket and posted to the address shown on the reverse of the Ticket within this period.
12. PLAYING BY SUBSCRIPTION
12.1 Players who wish to play LOTTO and LOTTO Plus via a Mail Subscription rather than play at a Retail Outlet may obtain an application form by contacting the National Lottery.
12.2 A Mail Subscription Player must be 18 years of age or over.
12.3 To enter, a completed Mail Subscription application form must be sent with the required payment or payment authority, to the National Lottery at the address shown on the form.
12.4 Payment can be made by money order, cheque or direct debit order for the required amount which must be made payable to the National Lottery.
12.5 Any Mail Subscription payable by money order, cheque or direct debit order for which Gidani has not received full payment in cleared funds prior to the date on which it would have, but for such non-payment, become a winning Subscription, is void and shall not in any case entitle its holder to a prize.
12.6 Where the Subscriber’s payment is dishonoured, the Subscriber’s number selection (s) will not be entered into the relevant Draws.
12.7 Gidani may at its discretion refuse to accept a Subscription.
12.8 Upon acceptance of a completed Mail Subscription application form and payment in full, (cleared funds) Gidani will process and send to the address entered on that form, a Subscription Certificate (the “Certificate”) which gives details of the Player’s Selection as recorded in its central computer system including an identifying subscription number.
12.9 Selections and the associated Subscriber or Recipient names may not be changed once entered into the central computer system.
12.10 A Subscription shall be deemed to have been received by Gidani on the date of the first Draw recorded on the Certificate.
12.11 Except as hereinafter provided, the Certificate shall confirm that, for the recorded number of Draws held by Gidani from and including the starting date shown therein, the Subscriber is deemed to have purchased each of the Boards indicated by the Certificate.
12.12 Notification of any change of Subscriber’s or Recipient’s address must be made in writing and signed by the Subscriber or Recipient, providing details of the change and including the Subscription number. The notification should be sent to the National Lottery address appearing on the Mail Subscription application form.
12.13 It is the responsibility of the Subscriber or where applicable, the Recipient to verify with the Subscriber, that the Certificate correctly shows the numbers selected by him/her and the number, frequency and commencement date of the Draws.
12.14 In the event of a discrepancy between the numbers contained in the Subscription or the Certificate and those contained in Gidani’s central computer system, only those numbers recorded in Gidani’s central computer system will be regarded to be the valid numbers for that Draw.
12.15 The liability of Gidani for any loss suffered by a Subscriber or a Recipient as a result of any discrepancy, whether or not the same was caused by an act of Gidani its employees, retailers or agents, and whether in negligence or otherwise, is limited to the amount of the Subscription monies.
12.16 Winners may be required to present the Certificate together with other identification as proof of entitlement to prizes.
12.17 The provisions of Rule 16 concerning submission of Claim Forms apply to Prize winners playing by Subscription.
12.18 Gidani reserves the right to cancel, alter or modify at any time the whole or any part of the LOTTO / LOTTO Plus Game subscribed for, and to cancel, alter or modify any Subscription or any condition attaching to subscriptions to the extent necessary or appropriate to reflect any such cancellation, alteration or
12.19 In the event of a cancellation of a Draw, Gidani will extend the Subscription to the next Draw. In the event of the cancellation of a Subscription, Gidani will make a proportionate refund to the Subscriber, or if applicable to the Recipient.
12.20 Where the Subscriber has assigned his rights in a Subscription to a Recipient and given notice to Gidani of that assignment, then all rights and obligations in respect of the Subscription (except only the obligation to pay sums due for the Subscription) will vest in the Recipient absolutely.
12.21 In the event of alteration or modification of a Draw, or of any conditions attaching to Subscriptions, Gidani may cancel the existing Certificate and issue a new Certificate reflecting such alterations or modifications. The new Certificate shall be effective from the first Draw date recorded on the Certificate.
12.22 There is no subscription facility available for QuickPick Tickets.
13. RESPONSIBILITY FOR TICKETS
13.1 It shall be the sole responsibility of the Player to verify at the time of purchase that the details recorded on the Ticket in terms of the Selection(s), number of Board(s), Draw date(s), and number of Draw(s) correspond with those marked on the LOTTO Entry Coupon or otherwise specified, and that a Serial Number and bar code appear on the Ticket.
13.2 Until such time as a name, ID number or address is placed on the reverse side of a Ticket, the bearer of a Ticket, which has been issued in accordance with the provisions of these Rules, shall be the owner thereof for the purposes of these Rules. When a name, ID number or address is entered on the reverse side of the Ticket, subject to the provisions of these Rules, the person whose name, ID number, or address appears on the Ticket shall be the owner of that Ticket for the purposes of these Rules.
13.3 The Player will be responsible for the safe custody of any Ticket.
13.4 Neither Gidani nor any Retailer will be responsible for loss, theft, mutilation or destruction of any Ticket or for any errors or omissions in respect of any data recorded on any Ticket or for any loss of whatever nature suffered or incurred by any person as a result of any such event or condition affecting a Ticket.
13.5 The Player is solely responsible for claiming from a National Lottery Office or an authorised Retailer the full value of the prize to which he/she is entitled.
13.6 The Player’s eligibility to win a prize is subject to the Ticket validation requirements set out in these Rules.
14. PURCHASE AND PRIZE RESTRICTIONS
14.1 There shall be no general right for any person to purchase a Ticket. In particular, but without limitation, no Ticket may be purchased by or prize paid to:
• Any Minor whether acting on his own or on behalf of another person.
• Directors of Gidani or Members of the National Lotteries Board.
• Such other persons or category of persons as Gidani and the Minister may determine from time to time.
14.2 If notwithstanding 14.1 above a prize is paid to a person in one of the groups set out in that Rule, such prize shall be repayable by that person to Gidani upon demand. Gidani or any Retailer, in its sole discretion, may refuse to sell Tickets to any person or persons without giving reasons. This may include circumstances in which, in its view, that person or persons are playing in a manner, which it or the Retailer deems to be interfering with other Players reasonable access to that Game.
14.4 LOTTO/ LOTTO Plus entries may be played manually using the Terminal keypad, by means of a LOTTO Entry Coupon hand-marked by or on behalf of the Player or by the QuickPick facility. Players must not use or seek to use facsimiles or copies of LOTTO Entry coupons, or other materials that are inserted into the Terminal’s Entry Coupon reader that are not approved by Gidani.
15. DISSEMINATION OF WINNING NUMBERS INFORMATION
15.1 The results of each Draw will be issued by Gidani to the National Media and may also be published in such other manner as Gidani from time to time may determine and will also be made available at Retail Outlets as soon as practicable after each Draw.
15.2 The information made available and disseminated will be:
• The date of the Draw.
• The winning numbers.
• The amount payable for each correct entry in each prize category.
• Such other information as Gidani may from time to time determine.
15.3 The dissemination and publication of Winning Numbers by telephone, in the media and at the Retail Outlets is for information purposes only, and Gidani will not pay a prize based upon information obtained from winning number information telephone lines or any other source other than the official Draw results recorded as in Rule 3 above and electronically recorded in the Gidani’s central computer system.
16. PAYMENT OF PRIZES AND CLAIM FORMS
16.1 All LOTTO and LOTTO Plus prizes will be paid in accordance with Gidani’s Prize Payout Procedures.
16.2 Each prize must be claimed within 365 days from the date of the draw.
16.3 Cash prizes of up to R50, are payable by all Retailers.
16.4 All Retailers have the discretion to pay up to R5 000 in cash.
16.5 Prize claims between R5 001-R50 000 are only payable at an authorised Prize Payment Centre (addresses are available from any Retailer or via Players’ ‘HelpLine) and claimants must complete a Prize Claim Form and provide proof of identity.
16.6 Prizes over R50 000 can only be paid in person to the Claimant or a duly authorised representative at a National Lottery Office after completion of a Claim Form and an identity check.
16.7 Gidani reserves the right, at its discretion, to require the completion of a Claim Form in any other case.
16.8 A Claim Form must be completed in the name of only one owner of a valid winning Ticket. However, Gidani may exceptionally and at its sole discretion, waive this requirement in respect of a particular prize claim, such waiver to be in writing and subject to such terms and conditions, as Gidani shall require.
16.9 All Claim Forms shall be completed and signed by the Claimant or his/her legally authorised representative.
16.10 Gidani may refuse to process for payment any Claim Form, which is incomplete.
16.11 If a Claimant is unable to complete a Claim Form due to legal, physical, or other disability, a legally authorised representative of the Claimant shall complete and sign a Claim Form on the Claimant’s behalf.
16.12 The Claim Form must state the name of the Claimant and/or the authorised representative and describe the status of the signatory, if not the Claimant. Gidani reserves the right to request evidence of the legal capacity of the authorised representative to claim.
16.13 If the person signing the Claim Form is a personal representative of the estate of a deceased Player, that person shall submit with the Claim Form such documentation as Gidani shall in its discretion deem sufficient to properly establish such representative’s entitlement to receive the relevant prize.
16.14 Payment of the prize to the person shown on the Claim Form as the Claimant or his/her duly authorised representative shall fully and effectively discharge Gidani, its officers, employees, representatives, contractors and any person, firm, company authorised by Gidani to pay LOTTO and/or LOTTO Plus prizes from any further liability for payment of that prize.
16.15 A person who signs a Claim Form shall be deemed to have represented that he/she is lawfully entitled to claim the Prize, the information contained therein is accurate and complete, and shall indemnify Gidani against any claims with respect to the Ticket or delivery of the prize as a result of any misrepresentation.
16.16 In the event of any inconsistency in the information submitted on the Claim Form and/or on the Ticket or for any other reason at its complete discretion, Gidani may investigate and withhold all winnings which may be due to the Claimant (or make a payment into court) until such time as the Claimant satisfies Gidani that he/she is the proper person to whom the prize should be paid.
16.17 In the event that a single Ticket contains multiple winning plays, each from separate Selections, the total prize amount shall be paid in accordance with the prize payment arrangement specified in Rule 16.1.
16.18 Neither Gidani nor any Retailer shall be responsible or liable to any person claiming an interest of whatever nature in a lost or stolen Ticket as a result of the payment of a prize to the bearer of an unsigned Ticket or to the person purporting to be the person whose name, ID number or address is entered on the reverse of the Ticket, whether or not advice of the loss or theft had been notified to Gidani prior to payment of the prize. Without prejudice to the above, Gidani shall use its best endeavours to carry out and ensure that any Retailers
or other persons responsible for payments of prizes shall carry out such identity checks and other security measures as Gidani shall in its discretion from time to time deem reasonable and appropriate in relation to payment of any particular prize amount.
16.19 In the event that Gidani, in its absolute discretion, believes that the bearer of a Ticket presented for payment or a person whose name, ID number or address has been entered on the reverse side of the ticket or who has completed a Claim Form is not the rightful owner thereof or lawfully entitled thereto, it shall be entitled to withhold payment of any prize winnings for a period of up to 365 days after the relevant draw, pending the outcome of all appropriate checks and enquiries.
16.20 Gidani shall not be liable to make payments of any prize on a Ticket, which it knows or suspects has been resold or otherwise transferred by way of trade. 16.21 Gidani shall not be liable to pay interest on any winnings in respect of any period during which security or other relevant checks or enquiries are in process regarding any Ticket presented for payment by a Claimant, or during any period in which a dispute relating to the validity of a Ticket or a claim has not been resolved.
16.22 A prize of R50 000 or less may be claimed, entirely at the Claimant’s risk, by posting the Winning Ticket together with a complete Claim Form to the National Lottery at the address shown on the Claim From. The Ticket shall contain the name and the address of the Claimant on the reverse side. If a Ticket is sent o the National Lottery that does not have a name appearing on the reverse side of the Ticket, payment will be made, subject to the provisions of these Rules, to the person whose name appears on the Claim Form.
16.23 If a Ticket that does not have a name, ID number and address is posted to the National Lottery Office together with an accompanying covering letter by a person who claims a prize, payment will be made subject to the provisions of these Rules, to the person whose name appears on the letter in which a claim is made.
16.24 Gidani will pay such Claimant by cheque or Electronic Money Transfer in accordance with Gidani’s procedures provided that all the Ticket validation requirements referred to in these rules have been met.
16.25 Gidani may apply to a court of competent jurisdiction to determine the lawful payee in any particular case.
16.26 Save as provided above, the right of any person to a prize shall not be assignable.
16.27 Under no circumstances shall any prize be payable by way of goods or services in lieu of cash, cheque, or electronic transfer.
17.1 Any person who purchases or submits a Ticket for validation or who claims a prize in whatever capacity, agrees to be bound by the provisions of the Act, any regulation made thereunder, the Licence to operate the National Lottery, and by the provisions of these Rules as amended from time to time by Gidani and approved by the National Lotteries Board.
17.2 Each prize winner is deemed to acknowledge that if and to the extent that Gidani is legally obliged to provide a third party with details of any prize claimed by or on behalf of, or paid to the prize winner, Gidani shall be entitled to do so.
17.3 Gidani may amend, modify, or otherwise change these Rules. Such amendments, modifications or changes shall be applicable with effect from their introduction and shall be applicable to prior Games so far as they relate to claim and prize payment procedures.
17.4 These Rules, the conditions and explanations appearing on Tickets and such other conditions as are established, constitute the contractual rights and obligations between Gidani and owners of Tickets and Claimants in respect of the LOTTO and LOTTO Plus Games. In the event of a discrepancy or inconsistency between the Rules and the conditions and explanations, appearing on a ticket or such other conditions as established by Gidani, these Rules shall prevail.
17.5 Where the context so requires in these Rules, the neutral gender shall include the feminine or masculine gender and vice versa and the singular shall include the plural and vice versa.
17.6 In the event that any provision of these Rules, or conditions appearing on a Ticket or such other conditions as may be established by Gidani, are determined by a court of competent jurisdiction to be void or unenforceable, such determination shall solely affect such remaining provision and shall not, in itself, render void or unenforceable the remaining provisions hereof.
17.7 No member of the Playing Public nor a Retailer shall enter into any special agreement for the sale of a Ticket or Tickets outside the method of play determined by Gidani and specified in these Rules.
18. LIMITATION OF LIABILITY
18.1 The Retailer is authorised by Gidani to sell Tickets, to pay prizes in respect of Valid Winning Tickets and to process Ticket cancellations in relation to LOTTO and/or LOTTO Plus in accordance with these Rules and to display and/or have available information produced by Gidani in respect of LOTTO and/or LOTTO Plus. Save as specified in the written agreement between Gidani and a Retailer, Gidani shall not be liable for any act or omission by a Retailer which is not covered in these Rules and/or Retailer.
18.2 If a Defective Ticket is purchased it shall be void and Gidani’s only liability shall be reimbursement of the cost of purchase.
18.3 If a Ticket is purchased which is cancelled whether in accordance with Gidani’s normal procedures for cancellation or otherwise, the only liability of Gidani (or the Retailer) as the case may be shall be the reimbursement of the cost of the Ticket.
18.4 Neither Gidani nor any Retailer shall in any circumstances be liable for any loss of whatever nature, including but without limitation, indirect or consequential loss, su fered or incurred by any Player, any bearer or owner of a Ticket, any Claimant or any other person arising from the withdrawal of any Game or from the participation or non-participation of any person in any Game, including the loss, for whatever reason, of the chance to participate in such Game. In particular, but without prejudice to the generality of the foregoing, neither Gidani nor any Retailer shall be liable to any person in the event of force majeure.
18.5 Gidani shall have the right to suspend or withdraw and/or to suspend the play of any Game from any Terminal at its absolute discretion at any time on account of:
18.5.1 the failure of, or damage to or destruction of Gidani’s central computer system or records, or any part thereof, or;
18.5.2 delays, losses, error or omissions in or made by the postal or other delivery service or by the banking system, or;
18.5.3 any other action or event which prevents or hinders the issue of a valid Ticket, or for the refusal to sell a Ticket to any person in accordance with these Rules.
19. WINNING SELECTIONS
19.1 Subject to the provisions of the Rules, a Player who, in respect of any Selection, has three or more numbers which match the main numbers will be entitled to a prize in the highest category to which those numbers relate.
19.2 Prize Division Seven means that the Player has correctly matched three numbers in any one Selection from the six numbers Drawn. The appropriate prize category is called MATCH THREE OF SIX MAIN NUMBERS (“MATCH THREE”).
19.3 Prize Division Six means that the Player has correctly matched three numbers in any one Selection from the six Drawn and matched the Bonus Number. The appropriate prize category is called MATCH THREE OF SIX MAIN NUMBERS PLUS BONUS (“MATCH THREE + BONUS”).
19.4 Prize Division Five means that the Player has correctly matched four numbers in any one Selection from the six Drawn. The appropriate prize category is called MATCH FOUR OF SIX MAIN NUMBERS (“MATCH FOUR”).
19.5 Prize Division Four means that the Player has correctly matched four numbers in any one Selection from the six Drawn and matched the Bonus Number. The appropriate prize category is called MATCH FOUR OF SIX MAIN NUMBERS PLUS BONUS (“MATCH FOUR + BONUS”).
19.6 Prize Division Three means that the Player has correctly matched five numbers in any one Selection from the six Drawn. The appropriate prize category is called MATCH FIVE OF SIX MAIN NUMBERS (“MATCH FIVE”).
19.7 Prize Division Two means that the Player has correctly matched five numbers in any one Selection from the six Drawn and the Bonus Number. The appropriate prize category is called MATCH FIVE OF SIX MAIN NUMBERS PLUS BONUS
(“MATCH FIVE + BONUS”).
19.8 Prize Division One means that the Player has correctly matched six numbers in any one Selection from the six Drawn. The appropriate prize category is called MATCH SIX OF SIX MAIN NUMBERS (“MATCH SIX”).
20. LOTTO PRIZE POOLS
20.1 The allocation of the Prize Pool to each of the LOTTO prize categories shall be in accordance with the following provisions:
20.1.1 Prize money allocated to each of the prize categories will be divided equally by the number of Winning Selections in that category.
20.1.2 If in any Draw, there are no Selections qualifying for a prize in the Match Six category the prize monies for this category will be added to the Match Six prize fund for the next Draw.
20.1.3 A jackpot will rollover for as many times as possible until it is won.
20.1.4 In the event of a Cancelled Draw or Draws for whatever reason, the prize money for Match Six category, rolled over from a Draw preceding the Cancelled Draw, will be added to the Match Six-prize fund for the next Draw.
21. LOTTO PLUS PRIZE POOL
21.1 The allocation of the Prize Pool to each of the LOTTO Plus prize categories shall be in accordance with the following provisions:
21.1.1 Prize money allocated to each of the prize categories will be divided equally by the number of Winning Selections in each of the categories.
21.1.2 The prize for Division 7 shall be fixed at a R7.00 (Seven Rand) per Match 3 numbers.
21.1.3 A non-winning LOTTO Plus Jackpot shall not be rolled over to the next Draw.
21.1.4 If in any Draw, there is no winner in any of the prize categories, the prize pool for the particular category will be evenly distributed among all other Winning Divisions, except Division Seven.
22. REFUNDS IN CERTAIN CIRCUMSTANCES
22.1 In the event of a Cancelled Draw Gidani shall:
22.1.1 refund to a Player who has purchased either a Ticket for the Cancelled Draw only or a Multi-Draw Ticket for the Cancelled Draw and other Draws, an amount equal to that part of the Ticket purchase price as was paid in respect of and is attributable to the Cancelled Draw.
22.1.2 refund to the Subscribers who hold a valid Mail Subscription for Draws which include the Cancelled Draw that proportion of the amount previously paid by the Subscriber for that Subscription as was paid in respect of and is attributable to the Cancelled Draw.
22.1.3 pay to a Player who holds a Ticket for the Cancelled Draw the amount that would have been properly payable by the Player had the player purchased that Ticket from a Retailer.
22.2 Any refund and payment under 22.1.1 and 22.1.2 above respectively must be claimed by the Player. The methods of claiming, payment, the validation of claims and subject to 22.3 below, the period within which such claims may be made being as determined by Gidani in its absolute discretion from time to time but subject to the prior agreement of the National Lotteries Board. A Player will in any event be required to produce the Ticket before any refund or payment will be made.
22.3 The period referred to in 22.2 above shall be a period expiring not earlier than the 90 days after the date on which the Cancelled Draw was to have taken place.
22.4 Any refund under 22.1.2 above shall be made by such means and within such period, as Gidani shall in its absolute discretion determine from time to time but subject to the prior agreement of the National Lotteries Board.
22.5 Neither Gidani nor any Retailer shall in any circumstances be liable to pay interest in respect of funds or payments made under this Rule 22.
22.6 For the avoidance of doubt, this paragraph shall not apply in respect of any Draw, which is delayed or postponed, or in respect of any Draw, which is defined as a cancelled draw.
23. DECISION OF GIDANI BINDING
Gidani’s decision as to whether or not a Ticket is a winning Ticket or in respect of any other matter or dispute arising from the payment or awarding or non-payment or nonawarding of prizes shall be final and binding upon all Players and any other person or persons having any interest in the matter or dispute. In the event of a dispute in respect of a winning Ticket, a Claim form, or the payment or awarding of any prize, Gidani may withhold payment of the prize and/or make an equivalent payment into court until the dispute has been resolved.
These Rules shall be governed by and construed in all respects in accordance with thelaws of the Republic of South Africa and the South African Courts shall have jurisdiction.

27. PAYMENT TO PERSONS UNDER A LEGAL DISABILITY
27.1 Gidani will make payment to the duly authorised representative of a person under legal or other disability.
27.2 Gidani may apply to a court of competent jurisdiction to determine the lawful payee in any particular case.
27.3 Save as provided above, the right of any person to a prize drawn shall not be assignable.
28. PRIZE PAYMENT BY MAIL
28.1 A prize of R50 000 or less may be claimed, entirely at the Claimant’s risk, by posting the winning Ticket together with the Claimants certified ID and physical address to the National Lottery at the address shown on the Claim Form. The Ticket shall contain the name and address of the Claimant on the reverse side. If a Ticket is sent to the National Lottery that does not have a name appearing on the reverse side of the Ticket, payment will be made, subject to the provisions of these Rules, to the person whose name appears on the Claim Form.
28.2 Gidani will pay such Claimant by cheque or EFT in accordance with Gidani’s procedures provided that all the Ticket validation requirements referred to in these Rules have been met.
